Terms of Sales

These conditions of sale are concluded on the one hand by La Vanilleraie de l'Océan Indien (owner of the online store: comptoirauxepices.com), represented by Christine Delplanque, whose head office is 23 chemin Chion Hock, 97432 La Ravine des Cabris (Reunion Island) hereinafter referred to as "The Seller" and on the other hand, by any natural or legal person wishing to make a purchase via the "comptoirauxepices.com" website, hereinafter referred to as "the buyer".

Object

These conditions of sale aim to define the contractual relationship between the Seller and the buyer and the conditions applicable to any purchase made through the seller's website, whether the buyer is professional or consumer. The acquisition of a good or a service through this site implies unreserved acceptance by the purchaser of these conditions of sale.

These conditions of sale shall prevail over any other general or special conditions not expressly approved by The Seller. The Seller reserves the right to be able to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer.

Characteristics of the goods and services offered

The products and services offered are those which appear in the catalog published on the Seller's website. These products and services are offered while stocks last. Each product is accompanied by a description established by the supplier; for some of them, marked DF, the buyer can have access to the supplier's documentation.

The photographs in the catalog are as faithful as possible but cannot ensure a perfect similarity with the product offered, in particular with regard to the colors.

Prices

The prices appearing in the catalog are net prices in euros and the VAT in force applies on the day of the order; any change in the rate may be reflected in the price of the products or services. The Seller reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer. The prices indicated on each product do not include the costs of order processing, transport and delivery as long as they take place in the geographical areas provided below. It is only before the payment of the complete order that you will have the final price including the ancillary costs!

Geographical area

The online sale of the products and services presented on the site is reserved for buyers who reside in France.metropolitan, in Reunion or in Europe and for deliveries required in these geographical areas.

Orders

The buyer, who wishes to buy a product or a service, must:

- complete the online order form giving all the references of the products or services chosen;

- validate his order after having checked it;

- make the payment under the conditions provided;

- confirm their order and payment. The confirmation of the order implies acceptance of these conditions of sale, the recognition of having full knowledge of them and the waiver of its own conditions of purchase or other conditions. All the data provided and the recorded confirmation will constitute proof of the transaction. Confirmation will be worth signing and acceptance of transactions. The seller will communicate by email confirmation of the recorded order.

Withdrawal

The Customer has a withdrawal period for his order of fourteen (14) working days from the date of ordering the products. This being like we market food products, for reasons related to hygiene, the retraction can be refused by our customer service. He alone will decide.

The Customer exercises his right of withdrawal by sending a registered letter with acknowledgment of receipt to The Seller, within fourteen (14) days. The Customer then has fourteen (14) days to return his product, after approval by customer service.

The Customer is then reimbursed for the price of the order and delivery costs, with the exception of return costs, by all means of payment. The Seller may defer the reimbursement until the product has been collected. Any order paid by credit notes / gift vouchers will be refunded in the form of a credit note.

The Customer must follow the product return procedure provided for in these general conditions.

The Customer has the obligation to return the product in good condition, under conditions specific to its re-marketing.

The Customer's right of withdrawal cannot be exercised when the Customer has ordered products and the product has been used or opened.

Payment terms

The price is payable when ordering.

Payments will be made by credit card, or Paypal they will be made through the secure system provided by Paypal and which uses the SSL (Secure Socket Layer) protocol so that the information transmitted is encrypted by software and that no third party cannot become aware of it during transport on the network.

The buyer's account will only be debited when the payment is validated.
At the buyer's request, he will be sent a paper invoice showing the VAT.

Deliveries

Deliveries are made to the address indicated in the order form which can only be in the agreed geographical area. The risks are the responsibility of the purchaser from the moment the products have left the premises of The Vendor.

In the event of damage during transport, a reasoned protest must be made to the carrier within three days of delivery. Delivery times are only indicative; if these exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed.

Guarantee

All the products supplied by the seller benefit from the legal guarantee provided for by articles 1641 and following of the Civil Code. In the event of non-compliance of a product sold, it may be returned to the seller who will take it back, exchange it or reimburse it. All complaints, requests for exchange or refund must be made by e-mail to the following address: contact@comptoirauxepices.com within seven days of delivery.

Responsibility

The seller, in the online sales process, is only bound by an obligation of means; it cannot be held liable for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, interruption of service, or other unintentional problems. Intellectual property All the elements of the site of The Seller are and remain the intellectual and exclusive property of The Seller.

No one is authorized to reproduce, exploit, redistribute, or use for any purpose whatsoever, even partially, elements of the site whether they are software, visual or sound. Any single link or hyperlink is strictly prohibited without the express written consent of The Seller.

Personal data

Personal information relating to buyers may be subject to automated processing. The Seller reserves the right to collect information on buyers including by using cookies, and, if desired, to transmit the information collected to commercial partners.

Buyers can oppose the disclosure of their contact details by notifying the Seller.

Archiving - Proof

The Seller will archive the purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code. The computerized registers of The Seller will be considered by the parties as proof of communications, orders, payments and transactions between the parties.

Litigation

These conditions of online sale are subject to French law. In the event of a dispute, jurisdiction is assigned to the competent courts of the jurisdiction of Saint Pierre de la Réunion, notwithstanding multiple defendants or warranty claims.
